This ECC Decision will supersede the MFCN part of current ECC/DEC/(12)01 which is also under revision.
Way forward agreed by ECC:
- Provision in the decides part on free circulation and use
- Exemption from individual licensing of mobile terminals should be covered by a considering similar to: “that mobile terminals fulfil the criteria for individual licensing exemption listed in ERC Recommendation 01-07 and therefore mobile terminals are exempt from individual licensing either implicitly by the rights of use granted to the terrestrial mobile network or by other national regulation”. No provision is needed in the decides part.
PT1 has to decide whether the frequency bands covered by this new ECC Decision should be explicitly listed as in current ECC/DEC/(12)01 or not, as it was in ERC/DEC/(95)01.
